IRS Section 453

The tax code lets you spread the capital gain. Most sellers don’t know it.

Sell your farm for cash and you write a check to the IRS for capital gains in a single tax year. It often reaches 20-25% federal plus your state tax. On a low basis asset your family has held for decades.

Sell on a Legacy Land Contract and IRC 453 let’s you recognize that gain only as principal payments come in. Across a five-year contract, you keep your money working instead of handing a quarter of it to the federal government year one.

For a $1.5 million low-basis farm, that is the difference between a $300k+ tax bill year one, and spreading that out over five year. While earning interest on your unpaid balance the entire time.
